Cookie Policy and Preferences
On our website we use small files called cookies to make your browsing experience better. In particular, cookies help us to make the site easier, faster and more interactive for you. This policy explains what cookies we use and how you can enable or disable them.
This policy forms an integral part of the general privacy policy, which can be found in the "Privacy Policy" section of our website, which we encourage you to read.
Who is the Data Controller?
The data controller (i.e., the entity that determines the purposes and methods of use of personal data) is Antonio Marras S.r.l., a company that is part of Oniverse, with registered office in Alghero (SS), Località Salondra n. 64, which can be contacted at data.protection@oniverse.com.
What are cookies?
Cookies are small text files that the website writes to your device. These text files help the site to remember, for example, your preferred language, your login credentials or the items you have placed in your shopping cart. Thanks to cookies, we can then collect information about your browsing and use it to make your online experience more personalised or simply easier.
Read on to find out which cookies we use, in detail, and how you can disable some of them, if you wish.
What cookies do we use? How to deactivate or activate them?
We use two types of cookies for our website: 'technical' cookies and 'profiling' cookies.
1. Technical cookies:
What are they? These cookies make our website easy to use, helping you to navigate and use our online services easily.
Why do we use them? Without these cookies some parts of the website would not be accessible or would be difficult to use. For this reason we do not require your consent to use them, they cannot be disabled and we install them based on our legitimate interest in ensuring that our website works properly.
What types of technical cookies exist? Technical cookies include: a) functionality cookies, which are used to make it easier for you to navigate around the site (e.g. by keeping track of your preferred language); b) analytical cookies, which allow us to collect statistical information in an anonymous form about, for example, the number of visitors and how they use the site. Where such information is not collected in aggregate form and it is therefore possible to identify you (through your IP address), these cookies qualify as "profiling cookies", which are only active with your consent.
2. Profiling cookies:
What are they? These cookies store information about your browsing habits, such as the pages you visit or the items you put in your shopping cart.
Why do we use them? We use this information to show you personalised content and targeted advertising, only after you expressly consent to their use.
What types of profiling cookies are there? They can be proprietary (or first party) and therefore managed directly by us or owned by our business partners (third party).
How to enable or disable them? You can enable or disable profiling cookies (by giving or revoking your consent) at any time, using our configurator or by changing the settings of the browser you are using to visit our site.
We may disclose personal information to third parties to engage them for online advertising and may collect your personal information when you visit our websites. In such cases, such information may be transferred to third parties through profiling cookies only on the basis of your explicit consent. For this reason, since we require your explicit consent to the use of third-party profiling cookies and the subsequent communication of such information to these third parties, the right to opt-out of your personal information sale, established by CCPA, does not apply.
Sharing excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Currently, we do not sell personal information, except in the case indicated above with reference to profiling cookies.
What is the duration of cookies?
Based on the duration of cookies, it is possible to distinguish between:
1. Temporary (or session) cookies:
What are they and how long do they last? These cookies store data only for as long as you are browsing the site. They are useful for keeping track of your actions but are not retained after you close the page.
2. Persistent cookies:
What are they and how long do they last? These cookies store data even after you have closed the browser. They are useful, for example, because they can remember your login password so that you don't have to type it in each time. You can find out how long cookies last by consulting the tables in the section 'List of Used Cookies'.
We process your data using IT and telematic tools and supports, in compliance with the provisions of the law to ensure security and confidentiality, as well as the accuracy, updating and relevance of the data with respect to the stated purposes. Help us ensure that your data is always accurate by communicating the updates to data.protection@oniverse.it
To whom do we disclose your data? Do we transfer them outside USA?
The information collected through cookies is communicated to
- Antonio Marras S.r.l. and Calzedonia S.p.A. personnel in charge of managing and monitoring the Websites;
- suppliers and consultants, subject to stipulation of a contract of appointment as data controller or a contract of co-ownership.
The personal data collected may be transferred outside United State of America, in particular within the European Union, and in some cases also to other countries around the world, in particular the United Kingdom (e.g. in connection with cookies, social media plug-ins and other software applications from third-party providers). In any case, the transfer will take place in compliance with local legislation (if any) and EU Regulation 2016/679 (‘GDPR’) (in particular, the data will only be transferred after signing the Standard Contractual Clauses approved by the EU Commission by Decision 2021/914/EU or to countries able to guarantee an adequate level of protection of personal data and therefore recipients of an Adequacy Decision adopted by the EU Commission).
What are your rights?
You can exercise your rights under the law regarding your personal data by writing to data.protection@ oniverse.com. We will endeavour to respond to your request as soon as possible and in any case no later than 30 days after receiving it. In certain cases, we may ask you for additional data if, in connection with your request, it is necessary to verify your identity.
Right of access
You have the right to know whether any personal data concerning you is being processed and - if confirmed - to obtain a copy of that data and to be informed about: the source of the data; the categories of personal data processed; the recipients of the data; the purposes of the processing; the existence of an automated decision-making process, including profiling; the data retention period; your rights under the Regulation.
Right of rectification
You have the right to have the data in our possession concerning you rectified or to add data that is incomplete.
We remind you that when you communicate your data to us in order to use our services, you guarantee its truthfulness and accuracy. Help us to ensure that your data is always accurate by notifying us of any updates at data.protection@oniverse.com.
Right of deletion
You have the right to request the deletion of your personal data if it is no longer necessary for the purpose for which it was collected or if we are no longer authorised to process it.
Right to limitation of processing
-
You have the right to obtain restriction of processing in the following cases:
-
You have contested the accuracy of your personal data. You can request the restriction of processing for the period during which we will verify the accuracy of your data;
-
We are not authorised to process your data and, instead of deleting it, you can ask us to restrict its use;
-
If the data in our possession - even though they are no longer necessary for us for the purposes of the processing for which they were collected - are necessary for you to establish, exercise or defend a right in court
-
You object to processing based on a legitimate interest of ours. Pending verification of whether our legitimate interests prevail over those of you as the data subject, you may ask us to restrict processing.
Right to withdraw consent
You may revoke your consent in relation to all processing based on it by accessing the configurator .
Right to data portability
If we process your data on the basis of your consent or in performance of a contract, or if the processing is carried out by automated means, you may exercise your right to data portability. You may then receive the personal data you have communicated to us in a structured, commonly used and machine-readable format. You may also request to transmit your data directly to another company, provided that this is technically possible.
Right to object
You have the right to object at any time to the processing of your personal data based on our legitimate interest, including profiling.
We also inform you that, if you consider that personal data concerning you are being processed in breach of the provisions of EU Regulation 2016/679, you have the right to lodge a complaint with the competent Data Protection Supervisory Authority.
In particular, if you are a Californian resident, under the CCPA, you have the right to request the deletion of personal information that we have collected from you. Once we receive and confirm your verifiable consumer request to delete, we will delete (and communicate to our service providers to delete) your personal information from our records, unless an exception applies (e.g. retaining the information necessary for us or our service provider(s) in order to complete the transaction for which we collected the personal information, providing a good or service that you requested, complying with a legal obligation etc.). With reference to the right to access/to know and the right of erasure/to delete, you may submit your requests, free of charge, by writing to data.protection@oniverse.it . We will need to verify your identity before processing your request, which may require us to request additional personal information from you or require you to log into your account. We will only use personal information provided in connection with a consumer rights request to review and comply with the request. Once submitted the request, you will receive an e-mail as soon as feasibly possible, but no later than 10 business days, confirming that we have received your request and providing information about how we will process your request. We will respond to your request to access/to know or erasure/delete within 30 days (as required by GDPR) from the day we receive the request even if, in case of Californian consumers, the CCPA sets a longer period of 45 days. Any disclosure in response to a request to access/to know will cover the entire period from the date of your registration to the website (as required by GDPR) even if, in case of Californian consumers, the CCPA sets that disclosure of personal information must cover the 12-months preceding the business’ receipt of the request to know. In certain circumstances, we may decline a request to access/to know and/or erasure/delete, particularly where we are unable to verify your identity.
If you are a Californian resident, under the CCPA, you may institute a civil action for statutory damages on an individual or class-wide basis (providing Calzedonia with 30 days’ written notice identifying the specific provisions violated) in the following cases: nonencrypted and nonredacted information subject to unauthorized access and exfiltration, theft or disclosure as a result of a business's lack of implementation of reasonable security procedures and practices.
If Calzedonia within 30 days cures the noticed violation and provides the consumer an express written statement that the violations have been cured and that no further violations occur, no action for individual statutory damages or class-wide statutory damages may be initiated against Calzedonia.
If you are a Californian resident, under CCPA, also the following rights will be applied:
- Right to Opt-Out of Personal Information Sale. Currently, we do not sell personal information, except in the case of profiling cookies. To learn more about profiling cookies, how to manage the use of such cookies and how to disable them, please see the section “What cookies do we use? How to deactivate or activate them?”.
- Right to Non-Discrimination. You have the right not to receive discriminatory treatment, in terms of price or services that we offer, for exercising any of the rights described above. However, please note that if the exercise of the rights described above limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you with our products or services or engage with you in the same manner.
- Financial Incentives. You have the right to be notified of any financial incentives offers and their “material terms” (terms and conditions), the right to opt-out of such incentives at any time, and to not be included in such incentives without your prior informed opt-in consent. We do not offer any incentives at this time.
Authorized Agent
In certain circumstances, you are allowed to use an authorized agent to submit the above requests on your behalf by writing to data.protection@oniverse.it. If you choose to submit a request through an authorized agent, we will require proof that the authorized agent has your written permission to submit a request on your behalf and, if necessary, we may require you to verify your identity with us.
If the agent cannot provide your signed permission, we may deny the request.
We reserve the right to update the content of this page from time to time. We therefore invite you to consult this policy regularly in order to keep up to date with any changes that have occurred since your last consultation.
